TERMS & CONDITIONS FOR EXTERNAL STORAGE UNIT RENTAL

1. Definitions

You, Your: denotes the individual renting the storage unit.

We, Us, Our: refers to the storage facility operator - New Concept Int Lda (Algarve Express).

Unit: the rented exterior storage space.

Goods: items stored in your unit.

Start Date: the date your rental agreement begins.

Access Hours: the times you’re permitted to enter the facility (as set out in your agreement).

2. Access & Use

Only the person named on the rental contract may access the unit. You may nominate additional authorised users, provided their names and IDs are registered with us.

You have access 24/7 via coded gate entry. We may adjust access hours temporarily for maintenance or emergencies with prior notice.

You are responsible for locking your unit securely. Only you should hold the key or code.

3. Condition & Inspection

Before placing any items in the unit, you must inspect it and report any damage or cleanliness issues. If no report is made, the unit will be assumed to be in satisfactory condition at the start of tenancy.

4. Prohibited Items & Activities

Storing illegal, flammable, explosive, perishable or hazardous goods (e.g. petrol, chemicals, weapons) is strictly prohibited.

You may not conduct mechanical work, make structural modifications, or attach items to the unit. Any damage caused by your actions or waste left behind may result in cleaning or repair charges.

It is strictly forbidden to leave any rubbish, packaging, or unwanted items outside your unit or anywhere within the storage facility grounds. All waste must be taken with you.

Failure to comply with this condition will result in the loss of your security deposit, and additional cleaning or disposal charges may also apply.

5. Liability & Insurance

You attest that you either own the goods or have express permission to store them.

Insurance is your responsibility. Standard cover is required (arranged via us or an approved insurer). You may opt for supplemental coverage at an additional cost.

We accept no liability for loss or damage to your contents, except in the case of negligence by our staff.

6. Fees & Payments

Rental fees are due monthly in advance, beginning on the Start Date. A security deposit equal to one month’s rent is payable at move‑in.

If a payment is declined or returned, a penalty fee applies.

We reserve the right to increase fees with a minimum notice period of four weeks; the updated rates will apply from the next payment cycle.

7. Non-Payment

If payment is not received by the due date, we may replace your lock and deny access, without terminating your contract. You remain liable for outstanding amounts.

After 14 days overdue, a written notice will be sent. If unpaid within 48 hours, penalty fees will apply. According to Portuguese law, if 365 days have passed since last payment we will remove, sell, or dispose of contents to recover costs.

8. Termination

Written notice of at least 14 days is required to terminate your agreement. If omitted, an additional month’s rent will apply.

You must vacate the unit in a clean, empty condition. Leaving items behind will incur disposal or cleaning fees which will be taken from your deposit.

We reserve the right to terminate the lease immediately if you are in breach of any term of this agreement.

9. Maintenance & Emergency Access

We may access your unit to perform routine maintenance with at least 7 days advance notice.

In emergencies, such as suspected prohibited goods or safety threats, we may enter without notice, including breaking the lock if necessary.

10. Miscellaneous

This agreement is governed by Portuguese law, and disputes may be referred to Portuguese courts.

If any part of these terms becomes invalid or unenforceable, the rest of the agreement remains binding.

You may not assign, transfer, or sublet your unit / rights under this agreement.

11. Force Majeure & Notice

We are not liable for delayed entry or exit caused by circumstances beyond our control (e.g., natural disasters, labour issues, power outages).

Any notices under this agreement must be in writing. Notices to you will be sent to your registered address; notices to us must use our registered office address.
